JEKA SOFTWARE WEBSITE PRIVACY POLICY

Effective Date. This version of this Policy takes effect on October 2, 2026. For a person who accepted the MyWatchtower Terms of Service, or an earlier version of this Policy, before October 2, 2026, this version takes effect on November 1, 2026, or on the date that person expressly accepts it, if earlier, and the earlier version continues to apply to that person until then.
This JEKA Software Website Privacy Policy (this "Policy") describes how JEKA Software, Inc., a Delaware corporation with its principal office in Land O’ Lakes, Florida ("JEKA," "we," "us"), collects, uses, discloses and retains information through its marketing websites, including without limitation https://www.jekasoftware.com (the "Website"). This Policy applies to everyone who visits the Website, submits a contact or demo-request form, or otherwise communicates with JEKA through the Website. This Policy covers the Website only. It does not cover the MyWatchtower platform (the "Platform"), which consists of the web application, entry kiosks, cameras, mobile applications and related services through which JEKA provides visitor management, entry processing and access control services to communities. Information generated through a Community’s use of the Platform, including without limitation entry and access records, event records, photographs, recordings, credential data and other Facility Data, is governed by the MyWatchtower Platform Privacy Notice (the "Privacy Notice"), and to the extent the Privacy Notice and this Policy overlap with respect to Platform data, the Privacy Notice controls. We do not collect Facility Data through the Website.
1. Information We Collect
1.1 Contact and Inquiry Information. When you submit a contact form, request a demo or email us, we collect the information you provide, which may include your name, email address, telephone number, postal address, company or Community affiliation, and the contents of your message.
1.2 Demo and Sales Records. We maintain scheduling details for the demos and meetings you request, and our correspondence with you about JEKA products.
1.3 Technical and Usage Data. We collect IP address, browser and device information, online identifiers, and log data about how the Website is used, such as the pages you visit and the links you follow.
1.4 Advertising Measurement Data. The Website loads a Google Ads tag that records whether your visit came from a JEKA advertisement and may add your browser to a Google Ads audience. The tag sets the _gcl_au cookie and transmits to Google your IP address, browser information and the page you visited, as described further in Section 4.
1.5 Spam-Prevention Data. The Website uses Cloudflare Turnstile, a service of Cloudflare, Inc., to distinguish human visitors from automated traffic. Turnstile collects your IP address, user agent, browser information and behavioral signals, and Cloudflare’s own privacy policy governs its processing of that data.
1.6 Text-Message Opt-In Data. If you opt in to text messages from JEKA, we collect the SMS data described in the JEKA Software SMS / Text Messaging Terms (the "SMS Terms") at https://portal.jekasoftware.com/policies/sms-terms/, which are incorporated into this Policy by reference. Mobile opt-in data and consent are not shared with any third party or affiliate for marketing purposes, and opting in to one program does not opt you in to any other program.
2. Sources of Information
We receive information directly from you when you complete a form, request a demo or contact us; automatically from your browser or device when you visit the Website; and from the spam-prevention service described in Section 1.5.
3. How We Use Information
We use Website information to: (a) respond to your inquiries and messages, schedule and deliver demos, and provide customer service; (b) send the text messages you have opted in to receive; (c) provide, maintain and improve the Website; (d) market and advertise, including without limitation by sending you information about JEKA products where permitted by applicable law, subject to your right to opt out of marketing at any time; (e) verify customer information, verify the quality and safety of our services, and audit compliance with our terms; (f) enforce the jekasoftware.com Website Terms of Use and resolve disputes; (g) investigate fraud, misuse, and deceptive or illegal activity, including without limitation unauthorized access to our systems and data, and pursue legal remedies against those responsible; (h) debug and repair errors; and (i) comply with applicable law and legal process.
4. Cookies and Similar Technologies
4.1 The Website's Cookie. As of the Effective Date, the Website sets one cookie: the Google Ads tag’s _gcl_au cookie, which is used to measure whether a visit came from a JEKA advertisement and to build Google Ads audiences. The Website does not use Google Analytics or Microsoft Clarity.
4.2 Cookie Policy. The JEKA Software Cookie Policy (the "Cookie Policy") at https://portal.jekasoftware.com/policies/cookie-policy/ discloses the cookies and similar technologies used across JEKA web properties, including without limitation the MyWatchtower application at mywatchtower.app, and applies to the Website as well.
4.3 Your Choices. You can manage Google’s ad personalization at https://adssettings.google.com or block the cookie through your browser settings.
4.4 New Technologies. Before we deploy any additional cookie or analytics tool on the Website, we will update the Cookie Policy’s inventory, obtain consent where applicable law requires it, and make the applicable opt-out mechanisms available.
5. How We Disclose Information
5.1 Service Providers. We disclose information to vendors that host the Website and deliver its content; to Cloudflare, Inc., which provides the Turnstile spam-prevention service; to Twilio and 3CX, which deliver text messages for our SMS programs; and to Google LLC, which receives the advertising measurement data described in Section 4. Each service provider is contractually obligated to safeguard the data and may use it only to provide services to us.
5.2 Legal Reasons. We may disclose information where required by law, subpoena or similar legal process, or where we believe in good faith that disclosure is reasonably necessary to enforce our rights, to address a threat to the safety of any person, or to maintain the integrity of the Website.
5.3 Business Transfers. We may disclose or transfer information in connection with a merger, acquisition or sale of all or part of JEKA's assets, subject to the commitments in this Policy.
5.4 No Sale. We do not sell personal information, and we do not share it with third parties for their own marketing purposes.
6. Retention
We retain contact-form and demo-request information for as long as reasonably necessary to respond to you and to maintain our business relationship, and for a reasonable period thereafter. We retain technical and log data for limited operational periods. We retain records of text-message consent and opt-outs for the periods required by applicable law. When we no longer need information, we delete or de-identify it in the ordinary course of business.
7. State Privacy Rights
7.1 Applicable Laws. Depending on where you reside, you may have rights under state privacy laws, including without limitation the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA); the laws of Colorado (CPA), Connecticut (CTDPA), Virginia (VCDPA) and Texas (TDPSA); the Florida Digital Bill of Rights, as to covered controllers; and other state privacy laws to the extent applicable.
7.2 Your Rights. Where those laws apply to the personal information we hold about you, they may give you the right to: (a) confirm whether we process your personal information and obtain a copy of it; (b) correct inaccurate personal information; (c) delete personal information, subject to legal and contractual retention requirements; (d) receive the personal information you provided to us in a portable and, to the extent technically feasible, readily usable format; (e) opt out of the sale or sharing of personal information and of targeted advertising; and (f) exercise these rights without discriminatory treatment.
7.3 Opting Out. We do not sell personal information, and we do not share it with third parties for their own marketing purposes. The Google Ads tag described in Section 4 may constitute "sharing" under some state laws, and you may opt out of it by submitting a request under this Section 7, through a Global Privacy Control signal, or at https://adssettings.google.com.
7.4 Nevada and Rhode Island Residents. Nevada residents may direct us not to sell their covered information under Nev. Rev. Stat. ch. 603A; as stated above, we do not sell personal information. Nevada and Rhode Island residents may submit requests and questions through the contact channels in Section 7.5.
7.5 Submitting Requests. Requests may be submitted to legal@jekasoftware.com, by telephone at (813) 939-7813, or by mail to JEKA Software, Inc., Attn: Compliance, 16703 Early Riser Avenue, Suite 533, Land O’ Lakes, FL 34638, and must include your name, the email address you used with us, and the right you wish to exercise.
7.6 Verification. We verify requests by matching the information you provide against our records, typically by confirming that you control the email address on file and, where reasonably necessary for a sensitive request, by requesting additional information, which we use solely for verification.
7.7 Authorized Agents. Where applicable law permits, an authorized agent may submit a request on your behalf. We require proof of the agent’s written authorization and may verify your identity directly with you.
7.8 Appeals. If we decline to act on your request, you may appeal by replying to our decision or by emailing legal@jekasoftware.com with the subject line "Privacy Appeal." We will respond to your appeal within the period the applicable statute prescribes, and if we deny your appeal, you may contact the Attorney General of your state.
7.9 Global Privacy Control and Do Not Track. We honor Global Privacy Control (GPC) signals as valid opt-out requests where applicable law requires. We do not sell personal information. Under some state laws, the Google Ads tag described in Section 4 may be treated as "sharing" for cross-context behavioral advertising, and where such a law applies to you, a GPC signal or a request under this Section 7 opts your browser out of the tag. The Website does not respond to browser Do Not Track signals, which you may enable or disable in your browser’s settings.
8. Safeguards
We maintain administrative, technical and physical safeguards appropriate to the nature of the data, including without limitation access controls and audit logging. No method of transmission over the Internet or of electronic storage is free of risk, and JEKA does not represent or warrant that unauthorized access to, or use or disclosure of, information will not occur.
9. Children
The Website is a general-audience site intended for adults. It is not directed to children, and we do not knowingly collect personal information from children under 13. If a visitor under 18 submits information through the Website, we use it only to inform that visitor that they may not use the Website, and we then delete it.
10. Third-Party Links
The Website may contain links to third-party websites and services. We do not control them, are not responsible for their content or privacy practices, and do not endorse them, and their own terms and privacy policies govern your use of them.
11. Changes and Contact
11.1 Changes. We may amend this Policy from time to time. The version posted on the Website, identified by the version number and effective date above, governs, and posting an amended version constitutes notice of the change.
