JEKA SOFTWARE WEBSITE PRIVACY POLICY

This Website Privacy Policy explains how JEKA Software, Inc., a Delaware corporation with its principal office in Land O’ Lakes, Florida (“JEKA,” “we,” “us”), collects, uses, shares, and retains information through our marketing websites, including https://www.jekasoftware.com (the “Website”). It applies to everyone who visits the Website, submits a contact or demo-request form, or otherwise communicates with us through the Website.
This Policy covers the Website only. It does not cover the MyWatchtower platform — the web application, entry kiosks, cameras, mobile applications, and related services through which JEKA provides visitor management, entry processing, and access control services to communities. Information generated through a Community’s use of that platform — entry and access records, event records, photographs, recordings, credential data, and other Facility Data — is governed by the MyWatchtower Platform Privacy Notice, and where that Notice and this Policy overlap for platform data, that Notice controls. We do not collect Facility Data through the Website.
1. What We Collect
- Contact and inquiry information. When you submit a contact form, request a demo, or email us, we collect the information you provide: name, email address, phone number, postal address, company or Community affiliation, and the contents of your message.
- Demo and sales records. Scheduling details for demos and meetings you request, and our correspondence with you about JEKA products.
- Technical and usage data. IP address, browser and device information, online identifiers, and log data about how the Website is used — the pages you visit and the links you follow.
- Advertising measurement data. The Website loads a Google Ads tag that records whether your visit came from a JEKA advertisement and may add your browser to a Google Ads audience; it sets the _gcl_au cookie and sends Google your IP address, browser information, and the page you visited. See Section 4.
- Spam-prevention data. The Website uses Cloudflare Turnstile, a service of Cloudflare, Inc., to distinguish human visitors from automated traffic. Turnstile collects your IP address, user agent, browser information, and behavioral signals; Cloudflare’s own privacy policy governs its processing.
- Text-message opt-in data. If you opt in to text messages from JEKA, the SMS data described in our SMS privacy terms at portal.jekasoftware.com/policies/sms-terms/, which are incorporated here. Your text-message opt-in consent is never shared with third parties or affiliates, and opting in to one program never opts you in to another.
2. Where It Comes From
We receive information directly from you (when you fill out a form, request a demo, or contact us), automatically from your browser or device when you visit the Website, and from the spam-prevention service described above.
3. How We Use It
We use Website information to respond to your inquiries and messages, schedule and deliver demos, and provide customer service; to send text messages you have opted in to receive; to provide, maintain, and improve the Website; for marketing and advertising, including sending you information about JEKA products where permitted (you may opt out at any time); to verify customer information, verify the quality and safety of our services, and audit compliance with our terms; to enforce the Website’s Terms of Service and resolve disputes; to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity and prosecute those responsible, and debug errors; and to comply with law.
4. Cookies and Analytics
As of the effective date, the Website sets one cookie: the Google Ads tag’s _gcl_au cookie, used to measure whether a visit came from a JEKA advertisement and to build Google Ads audiences. The Website does not use Google Analytics or Microsoft Clarity. The cookies and similar technologies used across JEKA web properties — including the MyWatchtower application at mywatchtower.app — are disclosed in the JEKA Software Cookie Policy, which covers the Website as well. You can manage Google’s ad personalization at https://adssettings.google.com or block the cookie in your browser. If we deploy additional cookies or analytics tools on the Website, we will update the Cookie Policy’s inventory before deployment, obtain consent where required, and provide the applicable opt-out routes.
5. How We Share It
- With service providers. Vendors that host the Website and deliver its content; Cloudflare, Inc., which provides the Turnstile spam-prevention service; Twilio and 3CX, which deliver text messages for our SMS programs; and Google LLC, which receives the advertising-measurement data described in Section 4. Service providers act under obligations to protect the data and may use it only to provide services to us.
- For legal reasons. When required by law, subpoena, or similar process, or to protect rights, safety, and the integrity of the Website.
- In a business transfer. In connection with a merger, acquisition, or sale of assets, subject to this Policy’s commitments.
We do not sell personal information, and we do not share it with third parties for their own marketing.
6. Retention
We retain contact-form and demo-request information for as long as needed to respond to you and maintain our business relationship, and a reasonable period after. Technical and log data is retained for short operational periods. Records of text-message consent and opt-outs are retained as required by law. When information is no longer needed, we delete or de-identify it in the ordinary course.
7. State Privacy Rights
Depending on where you live, you may have rights under state privacy laws, including the laws of California (the California Consumer Privacy Act, as amended by the California Privacy Rights Act — CCPA/CPRA), Colorado (CPA), Connecticut (CTDPA), Virginia (VCDPA), Texas (TDPSA), and Florida (the Florida Digital Bill of Rights, for covered controllers), and other state privacy laws as applicable. Where these laws apply to the personal information we hold about you, they may give you the right to:
- Know and access. Confirm whether we process your personal information and obtain a copy of it.
- Correct. Request correction of inaccurate personal information.
- Delete. Request deletion of personal information, subject to legal and contractual retention requirements.
- Portability. Receive a copy of the personal information you provided to us in a portable and, to the extent technically feasible, readily usable format.
- Opt out. Opt out of the sale or sharing of personal information and of targeted advertising. We do not sell personal information and we do not share it with third parties for their own marketing. The Google Ads tag described in Section 4 may count as “sharing” under some state laws; you can opt out of it by sending a request under this Section, through a GPC signal, or at https://adssettings.google.com.
- Non-discrimination. Exercise these rights without discriminatory treatment.
Nevada and Rhode Island residents. Nevada residents may direct us not to sell their covered information under Nev. Rev. Stat. ch. 603A; as stated above, we do not sell personal information. Nevada and Rhode Island residents may submit requests and questions through the contact channels below.
Submitting and verifying requests. Submit requests to legal@jekasoftware.com, by phone at (813) 939-7813, or by mail to JEKA Software, Inc., Attn: Compliance, 16703 Early Riser Avenue, Suite 533, Land O’ Lakes, FL 34638, with your name, the email address you used with us, and the right you wish to exercise. We verify requests by matching the information you provide against our records — typically by confirming control of the email address on file and, where reasonably necessary for sensitive requests, by asking for additional information used only for verification.
Authorized agents. Where the law allows, an authorized agent may submit a request on your behalf; we require proof of the agent’s written authorization and may still verify your identity directly with you.
Appeals. If we decline to act on your request, you may appeal by replying to our decision or emailing legal@jekasoftware.com with the subject line “Privacy Appeal.” We will respond to your appeal within the window the applicable statute sets, and if we deny your appeal, you may contact the Attorney General of your state.
Global Privacy Control and Do Not Track. We honor Global Privacy Control (GPC) signals as valid opt-out requests where required by law. We do not sell personal information. The Google Ads tag described in Section 4 may be treated as “sharing” for cross-context behavioral advertising under some state laws; where that law applies to you, a GPC signal or a request under Section 7 opts your browser out of it. The Website does not respond to browser Do Not Track signals; you may enable or disable DNT in your browser’s settings.
8. Security
We use administrative, technical, and physical safeguards appropriate to the nature of the data, including access controls and audit logging. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Children
The Website is a general-audience site for adults; it is not directed to children, and we do not knowingly collect personal information from children under 13. If a visitor under 18 submits information through the Website, we use it only to tell that visitor that they cannot use the Website, and we then delete it.
10. Third-Party Links
The Website may link to third-party websites and services. We do not control them, are not responsible for their content or privacy practices, and do not endorse them; their own terms and privacy policies govern.
11. Changes and Contact
We may update this Policy from time to time; the posted version, identified by the version number and effective date above, governs, and posting an updated version is notice of the change.
